
There is a separate National Security Appeals Panel (NSAP) of the Tribunal which hears appeals against certificates issued by a Minister of the Crown under Section 28 of the Data Protection Act 1998 (DPA), and sections 23 and 24 of the Freedom of Information Act 2000 (FOIA). Anyone directly affected by the issue of a certificate may appeal against it. The Tribunal applies the principles of judicial review to the certificate considering whether the Minister has reasonable grounds for issuing it.
Mr James Goudie QC, Chairs the National Security Appeals Panel. There are four other members of the panel, all Deputy Chairmen of the Information Tribunal, who are designated and appointed by the Lord Chancellor.
